1. Agreement to Terms

By using our services, you agree to these Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Comfort One Air Conditioning LLC (“Comfort One,” “we,” “us,” or “our”).

2. Services

We provide HVAC services including but not limited to: repair, replacement, installation, and maintenance of air conditioning systems, furnaces, heat pumps, ductless mini splits, and related equipment and accessories for residential properties in our service area.

3. Service Area

We serve Scottsdale, Paradise Valley, Cave Creek, Carefree, Phoenix, Fountain Hills, Desert Mountain, New River, Anthem, and Rio Verde, Arizona. Service availability may vary by location.

4. Scheduling and Appointments

We strive to provide same or next day service when possible. We will make reasonable efforts to arrive at the scheduled time. If we anticipate any delays, we will notify you as soon as possible.

5. Estimates and Pricing

  • All estimates for service are provided free of charge
  • For system replacement or installation, we provide free, fixed price estimates
  • Estimates are valid for 30 days from the date issued, unless otherwise specified
  • Final costs may vary if additional issues are discovered during service that were not visible during the initial assessment

6. Payment Terms

  • Payment is due upon completion of services unless otherwise agreed in writing
  • We accept major credit cards, checks, and cash
  • Financing options are available subject to credit approval and terms
  • A deposit may be required for installation projects

7. Cancellation Policy

  • Please provide at least 24 hours’ notice for appointment cancellations
  • We reserve the right to charge a cancellation fee for appointments canceled with less than 24 hours’ notice
  • We may reschedule appointments due to emergency situations, severe weather conditions, or other circumstances beyond our control

8. Warranties and Guarantees

  • We provide a 100% customer satisfaction guarantee on all services
  • New installations include a 10-year parts and 2-year labor warranty (upgradeable to 10 years)
  • Specific warranty terms vary by equipment manufacturer and service type
  • Warranty coverage may be void if:
    • Equipment is serviced by unauthorized personnel
    • Recommended maintenance is not performed
    • Equipment is used improperly
    • Damage is caused by acts of God, power surges, or other external factors beyond our control

9. Customer Responsibilities

You agree to:

  • Provide accurate information regarding your HVAC system and issues
  • Ensure reasonable access to the service area
  • Secure pets during service visits
  • Have a responsible adult (18 years or older) present during service

10. Liability Limitations

  • We are not responsible for pre-existing conditions or issues not directly related to our services
  • Our maximum liability is limited to the amount paid for the services provided
  • We are not liable for indirect, special, incidental, or consequential damages
  • We maintain appropriate insurance coverage as required by Arizona law

11. Property Access and Work Area

By scheduling service, you grant us permission to access your property as necessary to perform the requested services. We will take reasonable care to protect your property during service visits.

12. Licensing and Compliance

We are licensed, bonded, and insured as required by Arizona law. Our technicians are professionally trained and follow all applicable building codes and industry standards.

13. Independent Contractor Status

Our technicians are employees of Comfort One Air Conditioning LLC and are not commission-based. We are an independent contractor and not an agent or employee of any equipment manufacturer.

14. Privacy Policy and Communications

We respect your privacy and will only collect and use your personal information as necessary to provide our services. For more information, please request a copy of our Privacy Policy.

14.1 SMS and Email Communications

When requesting an estimate or scheduling service with us:

  • You may opt in to receive SMS text messages about your appointment, service updates, and promotional offers
  • You may opt in to receive email communications including service confirmations, educational content, newsletters, and special promotions
  • By providing your phone number or email address, you consent to receive communications from us through these channels
  • Standard message and data rates may apply for SMS communications
  • You can opt out of SMS messages at any time by replying “STOP” to any text message
  • You can unsubscribe from email communications by clicking the “Unsubscribe” link in any email or by contacting us directly

15. Dispute Resolution

  • Any disputes arising from our services will first be addressed through informal negotiation
  • If informal negotiation fails, disputes will be resolved through binding arbitration in Maricopa County, Arizona
  • The arbitration will be conducted according to the rules of the American Arbitration Association

16. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website or providing notification to customers. Continued use of our services after such modifications constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
